PTA Constitution

We parents and teachers of St. Peters’ College, Garaku having realized the need to come together for our common goal, do hereby wish to enact this constitution.
ARTICLE 1
SECTION 1- NAME
The association shall be called St. Peter’s College Parent-Teacher Association.
SECTION II-MOTTO
The motto of this association shall be “to Work and worship’’.

ARTICLE II
AIMS AND OBJECTIVES

  1. To promote unity and peaceful co-existence of the members of the Association.
  2. To help in the development of the school both academically and otherwise through the provision of moral and financial support.
  3. To help popularize the school to the public and defend its honour and integrity.
  4. To foster unity between the school management and the members of the Association.
  5. To promote the interest of the students in the school in every way possible.

ARTICLE III
SECTION I - MEMBERSHIP

  1. Anybody that has his or her child or ward admitted for studies in St. Peter’s College and the student is in the college.
  2. Anybody employed as an academic staff in St Peter’s college, Garaku.
  3. Representative of the Ministry Of Education (MOE) Zonal/Area Office, Kokona Local Government, Education Department.

ARTICLES IV
SECTION I  -  OFFICES
There shall be the following offices for the Association

  1. Chairman
  2. Vice chairman
  3. Secretary
  4. Treasurer
  5. Financial secretary
  6. P.R.O
  7. Welfare officer
  8. Auditor
  9. Ex- officio (2)

SECTION II - FUNCTION OF OFFICERS
The above named officers in section I shall constitute the executive council of the Association.

  1. CHAIRMAN
  2. Shall preside over all the meeting including the executive, emergency and general meetings of the association.
  3. Shall cause the summoning of all meetings. 
  4. Coordinate and harmonize the activities of the association.
  5. Delegate powers to any officer to discharge extra function for the overall benefit of the Association when the need arises.
  6. Perform such other function as may be prescribed elsewhere in this constitution.

The officers mentioned in section (i) above shall constitute, the executive council of the association including the principle of the school.
In addition to item (e),  the secretary, the financial secretary, and the welfare are from the side of the teachers while others, from the parents  shall come the president and the vice, the treasurer, the auditors and ex- officio(s)

  1. VICE- CHAIRMAN
  2. Assist the chairman in the discharge of duties.
  3. Act for the chairman in his/her absence, or when otherwise unable, to perform his duties.
  1. SECRETARY
  2. The secretary shall write and keep accurate records of all minutes.
  3. Read the minutes of previous meetings for subsequent adoption.
  4. Conduct all the correspondences of the Association.
  5.  Prepare the agenda for all meetings in conjunction with the chairman.
  6. Shall perform such other functions as may be prescribed elsewhere in this constitution
  7. Shall summon meetings on the directives of the chairman, or as decided by the Association or its executive.
  1. ASSISTANT SECRETARY
  2. Shall assist the secretary in the discharge of duties his/her in absence.
  3. Act on behalf of the secretary in his/her absence
  1. FINANCIAL SECRETARY
  2. Shall in conjunction with the principal be responsible for collecting the Association’s monies and hand it over to the treasurer within forty eight hours after collection.
  3. Keep accurate record of such money collected and expended.
  4. Shall issue receipts for all money collected.
  5. Prepare an annual financial report for presentation at a general meeting.
  6. Present on demand the association books of account his books to the Auditor(s) for necessary action
  1. P.R.O
  2. Shall be responsible for publicity of the Association’s activities.
  3. Shall be responsible for the Association’s public relation.
  1. TREASURER
  2. Shall collect all money due to the association from the Financial Secretary and deposit same with the Association’s bankers within 72 hours after collection.
  3. Keep accurate records of the association’s monetary transactions.
  4. Submit on demand account books to the auditor.
  5. Shall perform other functions as may be prescribed elsewhere by this constitution.
  1. AUDITOR(S)
  2. Shall be responsible for auditing the Association’s account
  3. Shall submit report during general meetings.
  1. EX-OFFICIO(2)
  2. Shall attend all meetings called by the council.
  3. Shall perform other functions as may be prescribed elsewhere by this constitution.
  4.  WELFARE OFFICER: The P.T.A welfare officer shall be in charge of both, the EXCO and the congress welfare in the course of meeting of both.

ARTICLE - V:
SECTION 1: TENURE OF OFFICE

  1. The tenure of office for any elected EXCO shall be a period of two years except as may be otherwise determined in accordance with this constitution.
  2. On the expiration of the first term of office, an officer may be eligible for re-election for another term of two years.
  3. No person shall be elected to the same post for more than two terms (four years).

ARTICLE- VI
SECTION 1 – ELECTION

  1. All members (as provided in Article III a & b) shall be eligible to vote and be voted for as stipulated in this constitution.
  2. All contestants must be parents whose ward (s) children are in      JS S1,  SS 1 or in both classes (for an Exco member to serve a complete tenure).
  3. Election shall be by raising of hands (i.e open balloting)
  4. No member shall propose more than one candidate for a post,
  5. There must be a seconder to the nomination. 
  6. There shall be no nomination and voting by proxy.
  1. Any Nomination of candidate to any elective post shall be made by the congress.
  2. Two or more persons shall be nominated for a post.
  3. A nominee shall stand elected if;
  4. He/ She has the highest number of votes cast in the elections.
  5. If there is a tie between aspirants, a fresh election to the post shall be conducted in which case the candidate with the highest votes stands elected.
  6. In case of two deadlocks between candidates during election as provided for in (2) above. The Chairman of the Electoral Committee shall be allowed to vote so as to break the deadlock.

  
SECTION II-ELECTORAL COMMITTEE

  1. Shall consist of four members.
  2. Members of the Committee shall be appointed during general meeting.
  3. The committee shall be an independent body, and shall vote or be voted for, unless as otherwise provided by this constitution.
  4. The committee shall arrange, conduct and supervise all elections
  5. The committee shall stand dissolved at the end of the election proceedings.

SECTION III -DISSOLUTION OF THE EXCO

  1. EXCO shall stand dissolved by a motion during general meeting at the end of each tenure of office.
  2. The dissolved EXCO shall hand-over all the properties of the Association in their possession within forty-eight (48) hours to the new EXCO or caretaker committee as the case may be.
  3. There shall be a caretaker committee when the need arises before the existing EXCO is dissolved.
  4. The caretaker committee shall handover all the Association’s belongings within forty-eight (48) hours to the newly constituted or elected EXCO.

SECTION IV-BYE-ELECTION

  1. Bye-Election shall be conducted to fill a vacant post provided that office does not become vacant within the last month of tenure of office of the EXCO, in which case a competent officer shall be extra charged with the responsibility of manning the vacant post.
  2. In case there is a deadlock between the candidates as the above-mentioned to such an office there shall be a Yes or No ballot principle.

 

  ARTICLE VII
SECTION 1-DISCIPLINE
The EXCO has the power to suspend any of its members on the following grounds.

  1. Misappropriation of Association’s funds
  2. If found ridiculing the Association’s  Name
  3. If found grossly wanting in the discharge of his/her duties.
  4. Such suspension shall be notified to the congress for final decision during meetings.
  5. Any officer impeached shall stand disqualified to contest for any election for a period not less than four years.

SECTION II – RESIGNATION

  1. In the event of Chairman resigning his office, he shall handover all properties of the Association to the Vice Chairman within 48 hours
  2. Any officer(s) that resigns his/her office than the Chairman shall handover all properties of the Association to the Chairman within 48 hours
  3. If the EXCO is removed by two or third of congress or resigned, a caretaker committee shall be appointed by congress as provided elsewhere in this constitution. (see section iii (c) of the constitution)
  4. With respect to (c) above, the secretary and the welfare officer can become members of the caretaker committee as provided in article VI section III sub section(d)

ARTICLE VIII
SECTION I - MEETINGS
a.      Normal meetings of the congress shall be held once a term and the EXCO shall fix the term, date, time,  and  the place for such meetings.
b.      Normal and emergency meetings of the EXCO shall be convened at any time the need arises.
c.       About 50% of the members present during a general meeting shall form a quorum.
d.      Not less than five members of EXCO shall form a quorum in its meetings.
e.       Parent/guardians who do not attend meetings shall be fined N500

SECTION II.      STANDING ORDERS DURING MEETINGS

  1. No member has the right to speak without due permission from the Chairman or his/her Vice in his absence
  2. Points of order and observation must be heard in line with the subject matter of the proceedings.
  3. The Chairman shall rule over all issues in case of controversies and such ruling shall be final.
  4. In case of gross misbehavior by any member, the Chairman has the right to send him out from the hall.

SECTION III THE EXECUTIVE MEETING
This shall consist of the following members:

  1. All the officers of the P.T.A
  2. Two Ex-office members(a male and a female)

ARTICLE-
SECTION I FINANCE -SOURCE OF INCOME AND EXECUTION OF PROJECTS

  1. All parents of the Association shall pay five hundred Naira (N500.00) as P.T.A levy per child each school term. This is subject to review when the need arises.
  2. Voluntary donations or any other legitimate means of raising fund may be desired by the EXCO.
  3. Other sources of income of the Association shall be levies and fines imposed on parents as determined and agreed by the members.

SECTION II - BANKERS

  1. The Banker to the Association shall be a bank agreed upon by the EXCO or the nearest bank to the school.
  2. Signatories to the P.T.A account shall be the chairman, principal and the treasurer.
  3. Any two signatories out of the three can sign cheques for withdrawal of money.

SECTION III - PROJECTS EXECUTION
All projects shall be executed by a committee (s) appointed by the Exco members during meeting (s)
ARTICLE X-
SECTION I-INTERPRETATION
There is need to create the office of a legal adviser to the school in the constitution to carry out all legal functions of the school.
ARTICLE XI –
SECTION I - AMENDMENT

  1. The constitution is subject to amendment
  2. A motion by a member to that effect shall be tabled before general meetings and seconded by one member or the other.
  3. The amendment shall then attract two third of the majority votes of members present provided that a quorum is formed.
